A Less Confrontational Dispute Solution

At The Bales Law Firm, we approach and prepare every case with the intention and the preparation to protect you and your family through the litigation process. However, mediation has become the courts’ preferred method of dispute resolution and has benefits in resolving legal disputes. 

Before litigation, mediation has become mandatory in most family courts as the first attempt to formulate an agreement. Should an agreement not be achievable, you are not obligated to accept the mediated agreement and can continue the legal process through the courts, but there are pitfalls in continuing to litigate in the court system.

Do you want to settle your dispute with your input and your decisions? Or have the court tell you what your settlement will be? 

Mediation provides for an opportunity to address the issues between two parties and attempt to comprise an agreeable settlement to avoid the emotional, timely, and costly litigation process of a resolution dictated through litigation and by the court.

Benefits of Mediation

The benefit of mediation is you are involved in the terms of the agreement, made in part by you and your attorney, and fortunately, not dictated to you by the courts. 

By finalizing a resolution agreeable between you and your estranged spouse or partner, makes for compliance with the terms is more easily achieved for you both are in agreement and will have had the opportunity to review the agreed-upon terms prior to your confirmation of the accepted solutions. 

Mediation additionally is less impactful on the children.

With the parents being able to directly address their children’s basic needs and personal issues, (emotionally, financially and level of support) of which you are most familiar, the impact on the children and their daily life and activities can be mitigated. 

Furthermore, mediation provides the opportunity for a less confrontational solution to your unique situation and makes for the transition to your post-divorce updated life much easier.
